this is a fair analysis..... gutierrez doesn't care for anyone as long as there is a provision for legalization...... he doesn't care for family unity either.... he just wants "legalization"...... but he could have done this without walking on me & beating me down.... in that sense it could it be interpreted that gutierrez is a jerk.... & like grassley..... he hates people like us.....

I just wanted to get an opinion of the gurus whether a person can deal with stock trading while on H1-B visa. Can someone point me to some documentation or laws on this? I plan to open an account with e-trade/scott trade .... Your comments are appreciated.

Uncle sam doesnot care as long as you pay the taxes on ur profits.

Forgive my ignorance, but would you be able to use the extension tubes mentioned above with a third party lens like the Sigma Gary mentioned? Obviously the Sigma lens would have to be a Nikon mount since the tubes mentioned above are Nikon, but assuming the mounts were the same would that work?

Ok I made the decision. I emailed my sponsor (employer) to change me from h1B to EAD and will be a part-timer. I will be working 10 hrs per week.
Possibly I might work 10-15 hrs with a different employer too (in same field).
I was asked to change I-9 form and update the changes.
Am I supposed to do anything else from my end, which my employer has not told me yet?
Do I need to file for ac21 if I am going to also work for a second employer (same field) for a part-time hrs on EAD? I will continue working with my sponsor employer , but on part-time hours for now.
DO we see any trouble with my GC processing?

Dude....think....How much is the GC worth to you. Things can change in an instant and might take ages to get the I-140 processed. Who knows? no one. Is there a guarantee that you will get it in 4 months? But something is for sure.....

1. assurance of you will get a result in 2 weeks. (approved or not....so you can take next steps)
2. give you relaxation. :)
3. You will get your GC in the end much faster.

Here is what I would suggest. Continue with your full time job and on the side start looking for a job and make sure that you get hold of good consulting company(ies). If they find you a position, they will/may file for the H1B Xfer. Once the H1b exfer is complete, you can go an join them.

What do you mean by good consulting company? Good consulting companies never care about H1 employees. Deloitte,accenture,IBM,Fujitsu, Cap Gemini all are good consulting companies.They place you in good projects,pay well but do not gaurantee about green card filing . Even if they promise you cant trust them. According to me, As long as you can find projects by yourself any consulting company who has good financials is a good consulting company and they will file your green card immediately. If they have good vendor contacts it will be a plus.

Its very natural to get paranoid about little things like signing the cover letter specially when we are at the mercy of USCIS. But is there an end to how much we can be paranoid about? No. So I suggest you sit tight and let the chips fall where they may.
Not signing the cover letter is not an issue in my opinion!

When I filed/sent my Paper based I-131 - Advance Parole (AP) form yesterday I forgot to attach the photographs along with it. I just realised it now.
Now what are the options I have. Will USCIS reject my I-131 - Advance Parole (AP) application packet and send it back or would they ask for RFE(Request for Evidence) of photograph.
Or is it OK to send the photographs and mention the Alien A# .
Has any body been through this situation before. I was planning on using AP for travel to INDIA in the few months now I guess I am in serious mess.
Your help is much appreciated.

Dear All,
Today, one of my Friend�s I-485 got returned from Mail room due to Filing fee missing.
He is 100% sure that he attached 325$+70$ filing fee along with application, he has photocopy too to prove his stand.
He is lucky, that he is re- filing it again, my question is , what happens, if the file get returned due to mail room clerks error . Can we refile again after 17th Aug,2007 ?

My Delhi Consulate Experience for my H-1B extention:
I am from Hyderabad but due to unavailability of appointments in Chennai consulate I applied through Delhi consulate. As a US Resident, I have an option of selecting any Consulate in India.
First they will check your DS 156 & DS 157 form when you are in queue to get in and also your application gets verified in a counter outside the main embassy and then you are let in, you can deposit your Cell Phones so don't leave your cell phones at home as we did, it was tough without a cell phone for half an hour after interview .
Once you get in into the embassy they do finger printing and then you are in queue to meet US Consular Agents.
While I was in queue, I saw lot of people getting rejected (mostly F1). They were asking unexpected questions to H1-B extension folks too. Questions like
1) Why did you change to this new employer?
2) How many employees does it currently have?
3) What does the company do?
4) How did you know about this company?
5) What was your masters in?
6) In my case they asked about names of the clients I was involved with through my IT services employer?
7) What are your job responsibilities?
They are trying to look at your body language and communication skills.
When I went to the counter he asked me about my previous company and current company, as mentioned above they asked me about how many clients I was involved with through my current employer. Then he said, he couldn't find my petitioner details online so he would check it and issue my visa if no further documents are required(I don't know what he meant by no further documents). I do not have my passport yet(12 Jan 09), I have submitted my docs on 9th Jan 09. I expect my visa to arrive sometime next week (hopefully). I thought he was just BS ing with me.Looks like he was honest. This happened in jan 2009. Even now, they are not willing to file PERM. My 6 year term expires in July 2012. So I still have some buffer to file for green card. My VP said ' we have got candidates, so we cannot file green card for you now.we will see after 6 months if job market recovers'. I dont think it is good time to file PERM.

2. Is it possible to file multiple PERM Labor Certifications through two different employers at the same time? If yes, could I choose the employer I would like to stay, if both gets approved approximately at the same time?
3. How long I can continue with future employment in the GC process?
4. If the Labor get audited, is it possible to apply for H1B extension after 6th year?
5. Is it possible to port I-140 & procedure involved to port with / without the consent of current employer.

I will be thankful to you if i can get the responses from some folks who have gone through the situation like mine.
Here is the summary of my case -
1) Came to US in 2004 on F1 visa.
2) Got the job in 2006. Company A applied for H1B in 2007. Got H1B visa stamped on passport valid from September 2007 to September 2010.
3) Was laid off on 16th Novmeber 2007.
4) Company B applied for H1B petition on 21st December 2007 using regular processing. No pay check from company B.
5) Company C applied for H1B petition in March 2008 using premium processing. Comapny C applied based on A and not based on B.
6) Company C's petition got approved but with I 797 B. No I - 94 attached. Attorney asked me to leave the country and come back with a new I 94 as i have an almost brand new visa. I did so. And started working with Company C. Meanwhile, company B's petition was approved in May 2008 without Adjustment of Status (means no I 94 attached only I 797 B)
7) Worked with company C from April 2008 to September 2008. Although, no pay check from 16th November 2007 to 1 April 2008 because company B did not provide any.
8) Got the job with company D. Company D applied for H1B petition and it was approved with I 94 attached ( means I 797A).
Now 2010 is coming and my visa will expire in September 2010.
I want to go to India to get the H1B stamp on my passport with the current employer's I 797 (which is employer D).
I do not have any documentation from Company B except receipt number for H1B petition. I do not have any pay check from company B.
I have paycheck from 1st April 2008 to 31 September 2008 from Company C and 1st October 2008 to till date from Company D.
Will i face problem during visa interview?

My Receipt Date is Sept 18th. I changed address before I got my receipt.
For address change,
1) On Sept 25th, I filed AR-11 online, then as a chain, modified the addresses on all my pending applications. I got letter confirmations. This happened in Sept.
2) I also called them in Nov to raise a SR since I did not receive the FP notices. In the SR, I again gave my new address.
3) Then today I got the status changed as Notice Returned as Undeliverable.
4) I called USCIS first thing in the morning and again raised a SR
5) I also took an Infopass to meet field office folks and ask for help
All this I did to my spouse also.

Employment contract/non-compete is the place to look. Now, if you haven't signed any employment contract with your employer (that says otherwise)- you are good to make that change.
My husband had only signed the offer letter, which did not talk about any employement contracts. There was a condition to pay some money if i left compnay before 1 year, which is not valid anymore for him.
So what you suggest what should be my bext step.

Documents are usually lost and replaced (via duplicates).
Just ensure that you scan the docs into PDFs or something like that (Most of the new home printers have this option). When a need comes, just print the PDF.
